KMC Plymouth’s Terms & Conditions of Business

GENERAL TERMS & CONDITIONS

The content of this document applies to all events hosted by Kadampa Meditation Centre Plymouth (KMC Plymouth) at its centre and those hosted at other locations such as its Branch Classes.

The term “KMC Plymouth” refers to the centre itself, its branch classes and all events and venues which it may host.

The term “event” refers to any Meditation Class, Lunchtime Meditation, Day Courses and Half Day Courses, Retreats, Urban Retreats, Away Day Retreats, Empowerments, Outdoor Meditations and any other class, course or workshop both advertised and hosted by KMC Plymouth via its website or other means.

By attending and/or booking any event you agree to the terms and conditions herein.

KMC Plymouth reserves the right to refuse entry to any person to any event or to seek the removal of any person without any entitlement to a refund, whose behaviour is considered by KMC Plymouth and/or its representatives to be anti-social, disruptive or otherwise deemed inappropriate.

Availability of a place at any drop-in class (i.e. has not been booked in advance) is dependant on safe seating limits and cannot be guaranteed. We will accommodate everyone within the safety limits of each venue but reserve the right to refuse entry if this causes the limit to be exceeded.

PRICING, BOOKINGS & CANCELLATIONS 

Payments

All pricing on the Centre’s website and publicity, and within the Centre’s shop and at Branch Class “Bookshops” are in pounds sterling. No other currency can be accepted.

Cash and all major credit and debit cards are accepted at KMC Plymouth and its Branch Class.

Pricing: General Listings

Pricing for specific events is as indicated on our website and official printed publicity. A current summary of prices is given on our website HERE.

Variations from our core pricing structure may exist for specific events and these will be clearly indicated in the relevant website and printed publicity materials. KMC Plymouth reserve the right to vary its pricing for specific individual events.

Pricing: Empowerments

Empowerments are individually priced as per the Centre’s website and written publicity for each event. Attendance is strictly by advanced booking only. Empowerments are chargeable to non-members and to Standard Members but are included, so effectively free,  within the Premium membership package.

Cancellations by Attendees and Refunds

All bookings bought and paid for made in person or via our TicketTailor Box Office are non-refundable except in the circumstances given below.

Bookings are non-transferable, but KMC Plymouth will consider prior notice requests for an individual’s pre-paid booking to be transferred to another person. We will require a written request and consent, for which an email is acceptable. Such enquiries should be made to the centre’s Education Programme Co-ordinator (EPC) who can be contacted HERE.

In the event of cancellation due to bereavement or a similar exceptional circumstance please contact the Education Programme Co-ordinator (EPC) to request consideration of a refund minus a 15% administration fee. The EPC can be contacted HERE.

Verbal bookings (reservations) made without payment do not guarantee you a place at an event and your “place” may be offered to another person who has paid in advance. To ensure your place, please book and pay for the event in advance either in-person or online.

Failure to attend a pre-booked paid event will not entitle the purchaser to a refund or transfer to an alternative future event.

Events Cancelled by Kadampa Meditation Centre Plymouth

In the unlikely event of that KMC Plymouth must cancel an event for which an individual has paid in advance to attend, the Centre will:

1. announce that the event has been cancelled via its website, social media and where details are available, and it is practicably reasonable to do so, by individual emails and/or phone calls to those who have booked,

2. contact by an email broadcast, attendees who have booked via our TicketTailor Box Office. Such emails will be from a TicketTailor email address,

3. offer at their own discretion to either:

a) reimburse the full value of the booking using the same method as for that of payment. Participants who have paid in advance by cash will be contacted by the Centre’s Administration Director to make arrangements for a refund, OR

b) transfer the booking to a similar future event to the same value, OR

c) transfer the booking to a future rescheduled time and date for the original event

KMC Plymouth will not be liable for any costs or damages resulting from the event cancellation including but not exclusively, travel expenses and subsistence. Likewise it will not be liable for any such loses due to any event ending prematurely due to reasons beyond the control of KMC Plymouth.

MEMBERSHIPS

Membership Tiers

Two tiers of membership are offered by KMC Plymouth. Current membership pricing is given on our website HERE.

1. Standard Membership includes:

• All general programme meditation classes – evenings and lunchtime classes, regardless of venue.
• All half day events including half day urban retreats
• Foundation or Teacher training programmes – requires separate enrolment

2. Premium Membership includes:

• All general programme meditation classes – evenings and lunchtime classes, regardless of venue
• All half day courses
• All full day courses
• All Empowerments
• Foundation or Teacher training programmes – requires separate enrolment
• Free MP3 event recordings of selected events – and will always exclude general weekday evening and lunchtime meditation classes, empowerments, Foundation Programme and Teacher Training Programme.
• Complimentary copy of the new text to be studied at the commencement of a new book on FP or TTP

General Terms & Conditions of Membership

Only the named membership holder will benefit from the membership.

Memberships are non-transferable.

Memberships payments are non-refundable. Where notice is given part way through a given membership month that the member wishes to end their membership immediately, no refund will be offered for any remaining days membership in the month and the membership, and benefits associated with it, will cease at the end of the pre-paid period.

The Foundation and Teacher Training Programmes are by separate enrolment and acceptance onto either programme is at the discretion of KMC Plymouth – please see our website HERE.

Kadampa Meditation Centre Plymouth reserves the right to refuse or end enrolment to a study programme to individual subscription members without it affecting their other membership benefits.

All enquiries, concerns or complaints regarding KMC Plymouth Memberships should be addressed to the Administration Director (AD) of KMC Plymouth who can be contacted via the options HERE.

MP3 recordings are only offered on selected events taught by the Resident Teacher of KMC Plymouth and selected guest teachers. Recordings are made available at the discretion of KMC Plymouth and are not guaranteed to be available for any given event. Questions regarding these recording may be address to the Education Programme Coordinator (EPC) of KMC Plymouth who can be contacted via the options HERE.

Free MP3 Downloads are only available to those premium members who  have a attended the relevant event. Due to the nature of Dharma teachings, MP3 recordings are not offered as a substitute to attending such events regardless of the circumstances.

Monthly Membership Subscriptions via PayPal

Membership purchased via our website is subscription-based using PayPal as a third-party provider and all subscription activity is made through their website. Purchasers are not required to have a PayPal account in order to purchase a PayPal subscription.

Membership is provided on an initial one-month minimum period.

Membership is charged at a fixed monthly fee which is dependent on the chosen Membership tier and is payable in advance.

Monthly subscriptions will automatically be collected via PayPal. If your payment does not clear, your membership will become void.

If you cancel your membership subscription via PayPal, your membership will expire at the end of the last calendar day before your monthly renewal date.

The cancellation of PayPal based subscriptions is via PayPal. KMC Plymouth cannot cancel members subscriptions on behalf of the member. Members will need to cancel their subscription themselves. Where difficulties arise, KMC Plymouth will do their best to help and advice members but ultimately, they will need to contact PayPal to resolve any issues.

KMC Plymouth will not accept liability or responsibility for any material, financial or other such losses incurred from using PayPal subscriptions. Any such issues should be addressed to PayPal. However, KMC Plymouth will undertake to provide advice and support as best possible in the event of an issue.

Monthly Membership Payment via Standing Orders

Members choosing this option will pay through standing orders from their banking account directly to KMC Plymouth.

Members will ensure that when setting up standing orders, “KMCP Membership” plus their name are clearly identifiable in the transaction name/payment reference.

KMC Plymouth will provide the payee details to members paying via this method.

Membership is provided on an initial one-month minimum period.

Membership is charged at a fixed monthly fee which is dependent on the chosen Membership tier and is payable in advance.

Monthly subscriptions will automatically be paid by the member’s bank via a standing order. If your payment does not clear, your membership will become void.

If you cancel your membership standing order, your membership will expire at the end of the last calendar day before your monthly renewal date.

The cancellation of standing order-based subscriptions is via the member’s bank by the member. KMC Plymouth cannot cancel members standing orders on behalf of the member. Where difficulties arise, KMC Plymouth will do their best to help and advice members but ultimately, they will need to contact their bank or building society to resolve any issues.

KMC Plymouth will not accept liability or responsibility for any material, financial or other such losses incurred from standing orders to pay for their membership. Any such issues should be addressed to the members bank or building society. However, KMC Plymouth will undertake to provide advice and support as best possible in the event of an issue.

Monthly Subscriptions via Advanced Cash Payments

Membership paid for in advance on a monthly basis in cash will only be considered by KMC Plymouth in exceptional circumstances. This option is only available on request to the Administration Director (AD).

KMC Plymouth reserves the right to refuse this option.

As for other membership payment options, non-payment will result in the termination of membership and the associated benefits.

KMC Plymouth will not accept liability or responsibility for any material, financial or other such losses incurred from advance cash payments for a membership.

Online Classes

Online classes are offered by KMC Plymouth on the basis of the information provided on its website.

All online classes are streamed live and must be watched in real time, at the advertised time of the stream.

Online classes must be booked online prior to the start of any class and must be made in a timeframe which ensures the confirmatory email which contain the hyperlink to view the class online is received before the class starts. The purchase of an online class cannot be made by means other than the online booking process indicated on the centre’s website.

It is the responsibility of the purchaser to ensure that:

• they are able to watch the online class at the times advertised for the live stream
• they have access to the email account used to book any ticket(s) in order to receive their class hyperlink,
• whichever electronic device is used to watch the class, they ensure it is fully charged or plugged into a charger or mains supply,
• smart TVs with a YouTube app are functioning with an internet connection which  is viable,
• when using mobile devices a strong enough signal to stream is available at their chosen location to view the class

KMC Plymouth cannot take any responsibility or liability for online classes missed due to internet connection failure or IT issues which do not arise at the Centre.

Where a technical failure at the Centre prevents a livestream starting or the livestream is lost part way through a class, the centre will contact purchasers by email to offer an alternative replacement date by means of goodwill compensation, but refunds are not given.

Replacement dates cannot be offered for circumstances which are beyond the control of KMC Plymouth and which prevent a ticket holder from viewing the livestream. Likewise, the centre cannot accept liability for any loses, financial or otherwise,

All online class purchases are non-refundable and non-transferable.

Bookings for online classes are for the sole use of the purchaser and links to classes will not be shared with third-parties. Sharing links may result, at the discretion of KMC Plymouth, in the sharers being barred from purchasing future online classes.

Whilst KMC Plymouth will try to assist online viewers where possible, it cannot provide any expert advice for hardware and streaming issues related to the device used to watch its classes.

Five-Class Pre-Paid Cards

The Five-Class Pre-Paid Card scheme is priced as advertised HERE, and offers five classes at a discounted price.

No time limit is applied, and the card may be used at any KMC Plymouth Centre evening drop-in class, or any branch evening drop-in class.

Cards cannot be exchanged for cash.

Cards cannot be used as either full or part-payment towards other events.

Cards are not valid for the purchase of online classes.

The balance of any unused classes on a card cannot be exchanged for cash.

Cards are non-refundable.

Cards are for the sole use of the purchaser and are non-transferable.

Cards will be purchased via the centre’s TicketTailor Box Office online. The purchaser will be given their physical card on the production of their proof of purchase (an email confirmation from our Box Office), at their chosen venue.

Gift Vouchers

Gift Vouchers are offered at various fixed values and are accepted in part or full payment of any event or shop purchase. Where the value of the Gift Voucher exceeds that of the purchase, credit will be given in the form of the new value of the voucher being detailed on the form on the reverse of the voucher. Please note:

• Unused Gift Vouchers cannot be exchanged for cash
• The balance of any remaining credit on a Gift Voucher also cannot be exchanged for cash
• Gift Vouchers are not time limited

Discounts

No concessionary discounts are offered by KMC Plymouth however, individuals may contact the Administration Director to discuss individual requests for discounted access to KMC Plymouth’s events. KMC Plymouth is a registered charity solely funded by the receipts from the events it offers to the public and receives no external funding.

KMC Plymouth believes that no person should be denied access to Dharma teachings for lack of funds and wherever possible will work with individuals on a case by case basis to enable such persons to access Teachings. KMC Plymouth does however, reserve the right to refuse entry or to enter into any agreement based on a person’s lack of funds and to exclude any precedents it has set in consideration of another grant of discount.

KMC Plymouth also reserves the right to withdraw any offers of previously agreed ongoing discounts at any time but will honour any prior agreement for which any form of payment has already been made by an individual to the centre for an event.

Shop Purchases at KMC Plymouth & Branch Class “Bookshops”

This policy statement is offered in addition to your legal rights.

Your Legal Rights: 

When you buy goods from a business, in law you have a number of rights as a consumer. These include the right to claim a refund, replacement, repair where the goods are faulty.

Our Policy:

Refunds for food products/perishables, books, booklets, and unwrapped CDs and DVDs, will only be offered where the goods are faulty.

Returns for an exchange will only be taken within 14 calendar days of purchase and we require the original proof of purchase to be produced and the return of the goods unused and in unopened packaging. No refunds will be offered outside of where there is a legal requirement. ​
